Our client was charged with:
- driving while disqualified
- unlawful use of a motor vehicle
- driving under the influence of alcohol
- driving with a prescribed concentration of alcohol, and
- aggravated driving without due care
He had been drinking with friends at a football function. During the night he was asked to leave the premises. His friend gave him his car keys and told him to wait in the car for him. Our client drove the vehicle onto the wrong side of the road and collided with a fence. His blood alcohol reading was 0.182.
We were able to have the charges of driving disqualified and driving with a prescribed concentration of alcohol withdrawn. We were also able to have the aggravated feature of the offence of driving without due care withdrawn.
Our client was fined $1,000 in total and disqualified from driving for twelve months, which is the minimum licence disqualification which could have been imposed in the circumstances.
Had the driving disqualified charge not been withdrawn, our client may have been sentenced to a period of up to two years imprisonment.
